1. Introduction

This Privacy Policy describes the policies and procedures established by Newgen Pte Ltd (we, us, our) for OnTheGoal digital platform comprising web application, its associated programs, features, content and services accessed from http://www.onthegoal.com and also any applications developed for Windows, Mac, mobile phones and other digital devices (herein after referred as Service).

Collecting personal information is necessary and incidental to the services we are offering. By publishing this Privacy Policy we want to help you understand

  3. what standards and safeguards are in place to protect the personal information that is collected and
  4. what are the rights of an individual with respect to his/her personal information with us.

Your Consent to this Privacy Policy

When you use our service, you are consenting to the collection, transfer, manipulation, storage, transmission, disclosure and other uses of your information as described in this Privacy Policy.

2. What information do we collect?

In the course of delivering this service, it becomes necessary for us to collect some personal information. The information we collect enables us to operate this service, identify the user of this service, personalise it and improve the experience to the user. As part of this service, we may therefore request, collect or display someof your personal information. A few ways in which this happens is enumerated below:

a. Information provided at the time of Account creation:

When registering an account with this service or when logging in using Facebook, Google or Twitter, you will provide your Name, email id (which also is your username) and password. You acknowledge that this information could be personal to you and by providing this information to us, you may allow yourself to be identified by us or others and therefore this may no longer be anonymous information. This information may also be collected through Third party services such as when logging in through Google, Facebook or such other services. We may use your contact information to send communications from time to time. While you may unsubscribe from these messages, we reserve the right to contact and may still find it necessary to send you messages such as resetting password or retrieving account information.

b. Content created by user:

This service allows you to generate content that is stored and accessed within this service. All content submitted by you to this service may be retained for an indefinite period even after you terminate your Account. If it becomes necessary to disclose such content to third parties, we may have to share the content in a way that does not reveal Personal information as described in this Privacy policy.

c. Non personal information collected through log files:

We may also collect an individual’s non-Personal Information such as their computer (Windows/Mac), Internet protocol (IP) address, network information, ISP (Internet service provider) details, browser data and information about cookies. This is not personal information and cannot be linked to any individual person. Such non personal information is collected automatically and is used in an aggregate form and not in a manner that will identify a user personally. This analytics data is used for general assessment of user behaviour at an aggregate level. This helps us to learn how to improve our service and serve the needs of our users better.

d. Information collected through email analytics

When you open or read anemail received from us, we may get a confirmation that it was opened, or read or a link inside the mail was clicked. We use this insight to track aggregate user behaviour to our mail communications and to figure out ways to improve our messages and deliver better service.

e. Information Collected Using Cookies:

A cookie is small amount of data that is transferred to your browser by a web server and can only be read by the server that gave it to you. It functions as an ID token and enables us to record your passwords, purchases, and preferences. It cannot be executed as code or deliver viruses. Most browsers are initially set to accept cookies. We use cookies to enable our servers to recognize when the user is using our services. This Privacy Policy covers our use of cookies only and does not cover the use of cookies by third parties. We do not control when or how third parties place cookies on your computer or device.

3. How do we use and disclose the personal information collected?

We are committed to the protecting the privacy rights of our users. We believe that establishing trust with our users will be the foundation for our success.

a. We use the personal information collected only as part of the requirement to deliver the service and for communication with the user. As a matter of principle, we will not collect any personal information other than for the purpose for which it was collectedwith the individual’s permission.

b. We will retain Personal Information for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law

c. We will not disclose or sell an individual’s Personal Information to unrelated third parties under any circumstances. Possible exceptions when we may have to share personal information could be:

i. When we have to sell our service or business to another party in which case all the information could be transferred to the acquirer

ii. Where we reasonably believe that an individual may be engaged in fraudulent, deceptive or unlawful activity that a governmental authority should be made aware of

iii. As required by any law enforcement agencies

d. We may use third party mail services like Google, Mail Chimp or other similar hosted services that manage mail automation in which case we may have to store email and contact information of our users with them.

  1. This service is designed to help you plan your goals, tasks and events and also allow you to selectively share such information with other users based on specific permissions you grant them when you activate the collaboration features of the service. As a result, some of your activity on this service and done through this service (such as user generated content) could be public and could be shared with other users based on permission granted to them to access that information. Other registered users may therefore have access to some of the information you have chosen to share with them.
  2. When you activate the sharing features available in this Service, you may be able to share personal information to other users. In such circumstances the shared information is your responsibility and is governed by the privacy settings of those particular sharing features. Those users with whom such personal information is shared, may use or disclose it others without our control and without your knowledge. We therefore urge you to exercise utmost caution when disclosing specific information to other users and not share what you deem as private and confidential information.
  3. The IP address information we collect and store is normally not made public. However this information may get shared with our partners, service providers and others with whom we conduct business in certain business contexts.
  4. Sometimes you may be accessing other third party services when using this service, by clicking on certain third party links. Such third party links may include sponsors, advertisers or links to other affiliate services that may offer products or services that our users might find useful. These sites may request information from you. In such instances, the collection and use of your personal information will be governed by the privacy policy applicable to that site. We do not control the privacy policies, contents or links that appear on these sites. We encourage you to review the privacy policies of any third party sites or services before providing any of them with your personal information.
  5. We may use your email address to periodically send you communications and updates relating to your Account and also other messages that we deem as helpful to our users. We will never spam you and you will always have the option to opt out of these emails, except those that we have to mandatorily send such as password reset information or email verification or Account confirmation / deletion. In such cases the emails are sent based on specific account related action requested by the user.

Other registered users may be able to see your user profile information or your profile image or other information you have chosen to make it available for other users with whom you have chosen to interact using this service. Under any circumstances your email will not be disclosed to other users.
  7. We use contract staff and agents to perform certain tasks associated with this service. We may have to share personal information with them in order to deliver, run, update and upgrade this Service. These agents do not have any right to use the personal information beyond the reasons for which they have been contracted to assist us. You hereby consent to our sharing of personal information with such contract staff and agents.
  8. At some point in time, the business could be transferred or acquired and in such instances the buyer typically buys the business assets/ including user information. Or in the unlikely event of this Service becoming unsustainable and forced to liquidate then such information could be transferred or acquired by a third party. You hereby consent that in such instances when a transfer occurs, the acquirer may take over the personal information and continue to use it as set forth in this policy.
  9. Additionally we reserve the right to read, access, store, retrieve and disclose any information pertaining to any user under the following circumstances:
    1. Respond to user support requests
    2. Respond to regulatory and government authorities
    3. For detection and prevention of fraudulent, unlawful activities, spam prevention and security threats
    4. Protect the rights, safety of us, our users and public
    5. Enforcement of privacy terms including investigations of potential violations if any

4. How safe and secure is my personal information within this Service?

We take security and safety of user information very seriously. We endeavour to keep your Account information (including your logins created through third party services like Google, Facebook, Twitter) secure and private. We store all user information using security techniques that are well regarded and accepted as good standards for keeping data secure. We use strong encryption methods during data transit and at rest. In spite of our best efforts and intent to safeguard and protect user information, we cannot guarantee that the security and safeguards we put in place will be fool proof and it may be possible that any account information could be breached by server intrusions, unauthorised access by hackers, hardware or software failure and other factors outside of our control and that may potentially compromise the security of user information at any time.

5. Deleting user account

If you do not wish to use the service anymore and wish to delete your account, you may do so by logging into your account and going through your Account settings. Once you choose to delete your Account, all account data and related information of that account will be deleted from the site and will be no longer accessible by you. However for security purposes the underlying data from deleted Accounts may be stored in our data base for a certain period of time.

6. Exceptions to Privacy Policy

While we are committed to keeping your information secure and private, we have the following exceptions to our privacy policy: We may be forced to release specific information about you or your account to comply with any valid legal inquiry or court order. We will also release specific information in special cases, such as if there is an attempted breach of the security of the site, or a physical or property threat to you or others. Further, the information you enter when making a purchase or an online donation will be shared with payment processors, financial gateways, and your credit card company to authorize credit card payments. Such information may also be shared with necessary third parties solely for the purpose or carrying out the transactions. Please note that if you give out personal information online through a discussion board or posting site, that information can be collected and used by third parties. Although we strive to protect our users' privacy, we cannot guarantee the security of information you post in community boards, forums or social media. You disclose such information at your own risk.
